Terms of service.
The deal between you and us — what you can expect when you buy merch, book a session or run a campaign with The Boyz.

These terms are between you and The Boyz Ke, a podcast, media and merchandise brand based in Ruiru, Kenya ("we", "us", "our").
By using theboyz.ke — browsing it, messaging us, booking a session or placing an order — you agree to these terms. If you do not agree with them, please do not use the site.
How we handle your personal information is set out separately in our Privacy Policy, which forms part of these terms.
2. Using the site
You may use this site for your own personal, non-commercial purposes, and to deal with us in good faith as a customer or partner.
You agree not to:
- Copy, scrape or republish our content without written permission
- Submit false, abusive or misleading information through any form
- Attempt to gain access to the studio dashboard or anyone else's order history
- Interfere with the site's operation, security or availability
- Use the site for anything unlawful under Kenyan law
We may withdraw access to the site, refuse an order or cancel a booking if these terms are broken.
3. Your account
You sign in with Google. You are responsible for keeping your Google account secure — anyone who can access it can see your order history with us.
Signing in is only required to place an order. You can browse everything else, message us and book a session without an account.
4. Merch orders
All prices are in Kenyan Shillings (KES) and include any applicable taxes unless we say otherwise.
Adding something to your bag does not reserve it. A contract is only formed when we confirm your payment and send you a receipt by email — not when you submit the checkout form.
Order totals are calculated on our servers from the live catalogue at the moment you check out, so the price you pay is the price we hold on record. If a price is shown incorrectly because of an obvious error, we will contact you before charging you, and you may cancel.
We may refuse or cancel an order if an item is out of stock, if we cannot verify your delivery details, or if we suspect fraud. If we cancel after you have paid, you get a full refund.
Payment is handled by Paystack. Your payment is confirmed by Paystack directly to us; until that confirmation arrives your order shows as awaiting payment. If a payment is confirmed for the wrong amount we will place the order on hold and contact you before shipping.
5. Delivery
We deliver within Kenya. Delivery times depend on your location and the courier, and any timeframe we quote is an estimate rather than a guarantee.
It is your responsibility to give us a correct delivery name, phone number, town and address. If a delivery fails because the details were wrong or nobody was reachable, we may charge you again for redelivery.
Risk in the goods passes to you on delivery.
6. Returns and refunds
If an item arrives faulty, damaged or is not what you ordered, contact us within 7 days of delivery at theboyz.ke@gmail.com with your order reference and a photo. We will repair, replace or refund it, and we will cover the return cost.
For change-of-mind returns, contact us within 7 days of delivery. The item must be unworn, unwashed and in its original condition with any tags attached. You cover the return postage, and we refund the item price once we have received and checked it.
Refunds are made to the original payment method and normally take 5–10 working days to appear, depending on your bank or mobile-money provider.
Nothing here affects your statutory rights under Kenyan consumer law.
7. Bookings and collaborations
Submitting the booking form is a request, not a confirmed session. You will receive a reference number immediately, but the slot is only yours once we confirm it by email — normally within 48 hours.
We may decline a request, or propose a different date, at our discretion. If you need to cancel or move a confirmed session, give us as much notice as you can.
Unless we agree otherwise in writing, we own the recordings we produce and may edit, publish and promote them across our channels. You grant us permission to record you and to use your name, likeness and contributions in the published episode and in promotion of it.
8. Services and advertising
Rates shown on the Services page are indicative starting points, not binding offers. Any campaign, sponsorship or production work is governed by a separate written agreement covering scope, deliverables, timings and payment.
Audience figures and reach estimates on this site are based on our historical performance. They are honest projections, not guarantees of the results any particular campaign will achieve.
We reserve the right to decline advertising or partnerships that conflict with our values or our audience's interests.
9. Intellectual property
The Boyz Ke name, logo, wordmark, episode content, merch designs, photography, written copy and the design of this site are our property or licensed to us. They are protected by copyright and trade mark law.
You may share links to our pages and episodes freely. You may not reproduce our designs on merchandise, use our branding to imply a partnership that does not exist, or republish our content commercially without written permission.
10. What you send us
If you send us an idea, a pitch, a clip or any other material, you confirm that it is yours to share and that sharing it does not break anyone else's rights.
You keep ownership of what you send. You grant us a non-exclusive, royalty-free licence to use it for the purpose you sent it for — for example, to assess a collaboration request or to run a campaign we have agreed.
We receive a lot of unsolicited ideas. If we later produce something similar that we developed independently, that is not a breach of this agreement.
11. Third-party content
Episodes play through embedded YouTube players, and this site links to partner websites and social platforms we do not control. Your use of those services is governed by their own terms and privacy policies, not ours.
Partner listings on this site describe businesses we work with. They are not an endorsement of everything those businesses do, and we are not responsible for their products or services.
12. Availability of the site
We work to keep the site up, but we do not guarantee it will be available without interruption. Parts of it depend on services we do not run — hosting, payments, email and YouTube — and any of those can fail.
We may change, suspend or remove any part of the site, including products, prices and published rates, at any time and without notice.
13. Liability
The site and its content are provided as they are. To the fullest extent the law allows, we exclude implied warranties about the site's accuracy, availability or fitness for a particular purpose.
We are not liable for indirect or consequential losses — including lost profit, lost data or lost opportunity — arising from your use of the site.
Where we are liable in connection with an order, our total liability is limited to the amount you paid for that order.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
14. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising from them.
If any part of these terms is found unenforceable, the rest continues to apply.
We may update these terms from time to time. The version published here when you place an order or make a booking is the one that applies to it.
